Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and named by you, take possession of the goods. If you order several works in a single order and these are delivered separately, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and named by you, take possession of the last work.

To exercise your right of withdrawal, you must inform us (Xenia Beliayeva,Helenenstraße 16, 22765 Hamburg, Germany, telephone: +49 172 4328273, email:xenia@beliayeva.com) by means of a clear statement, for example a letter sent by post or an email, of your decision to withdraw from this contract. You may use the model withdrawal form for this purpose, but it is not obligatory.

Alternatively, you can use the Cancel contract function or button on our website beliayeva.com. If you use this online function, we will send you an electronic acknowledgement of receipt of your withdrawal by email without delay, containing your declaration together with the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to Xenia Beliayeva, Helenenstraße 16,22765 Hamburg, Germany, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

Return costs

You will have to bear the direct cost of returning the goods.

If the work can be returned by ordinary post — this applies to works on paper and works on canvas up to and including 50 × 70 cm — you arrange and pay for the return yourself.

If this is not possible because of its nature — for large-format works on canvas from 60 × 80 cm upwards — we will arrange collection in consultation with you. For this we charge you at most EUR 59 within Germany and at most EUR 79 for returns from abroad; where the actual direct cost is lower, we charge only that lower amount. This amount will be set off against the purchase price to be refunded to you. We bear any transport costs beyond this.

Returning the work and condition check

Please pack the work carefully and securely for transport and return it in the condition in which you received it.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exception to the right of withdrawal

There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer's personal requirements (§ 312g (2) no. 1 of the German Civil Code). This concerns commissioned work created to your specifications.

This exception does not apply to the finished original works offered from stock on this website, even though every work is unique. For those works you have the full statutory right of withdrawal.
