Seller and offer

These terms apply to orders for original works of art placed through beliayeva.com. The seller and contracting party is Xenia Beliayeva, Helenenstraße 16,22765 Hamburg, Germany, email: xenia@beliayeva.com, telephone: +49 172 4328273.

What is sold are the original works described in the respective product description. Every work is unique. Details of size, material, framing and what is included are given with each work. Colours may appear differently on screen than in the original. Your statutory rights in respect of defects are unaffected.

Order and conclusion of contract

The presentation of works on this website is an invitation to order and not yet a binding offer.

Selecting the buy button for a work takes you to our payment service provider, Stripe. There you will see the work, the total price and the delivery details, and you can check and correct your entries before completing the purchase, or abandon the process. By selecting the final button, which is clearly marked as entailing an obligation to pay, you make a binding offer to purchase and make payment at the same time.

The contract is concluded when that payment process completes successfully. No further declaration of acceptance is required. Every work is unique, and the payment process is limited to a single payment per work — a work therefore cannot be sold twice.

You will receive confirmation of the contract, including these terms, the information on withdrawal and the model withdrawal form, by email without delay after the contract is concluded. We store the contract text and send it to you with that confirmation. Please keep this email. Permanent online access to the contract text is not promised.

Prices and payment

The prices shown on this website are final prices. They include the value added tax applicable to the respective sale as well as delivery to the stated destination. For sales of the original works offered here that are taxable in Germany, value added tax of 7 % is included in the price.

Payment is processed through Stripe. The payment methods available for your order are shown during the payment process. Payment is due on conclusion of the contract. Dispatch follows receipt of payment.

For deliveries outside the European Union, additional customs duties, import taxes and other import charges may arise. These are not included in the purchase price and are borne by the buyer. The competent authorities of the destination country can provide information.

The goods remain our property until payment has been made in full.

Shipping and delivery

Shipping is free worldwide, provided delivery to the respective destination is legally and practically possible.

Delivery time from receipt of payment is 3 to 5 calendar days within Germany. For deliveries to other EU countries and outside the EU it is up to 14 calendar days. Preparation for dispatch is included in these periods. For deliveries outside the EU, customs clearance may cause additional delays. We will inform you without delay of any delay that becomes apparent. Your statutory rights in the event of late delivery are unaffected.

Works are packed carefully for transport. Where the buyer is a consumer, we bear the risk of loss or damage during shipping until the goods are handed over to you or to a person named by you. Please report visible transport damage to xenia@beliayeva.com as promptly as you can. Failure to report does not limit your statutory rights.

Large canvases on overseas deliveries

For overseas deliveries, large works on canvas may be rolled and shipped without a stretcher frame so that they travel safely. The work must then be professionally mounted on a stretcher frame at the destination. The work and costs required for this are not included in the purchase price and are borne by the buyer unless expressly agreed otherwise.

Whether this form of shipping is intended for a particular work and destination country is agreed with you individually before the contract of sale is concluded and recorded in the order information. A work offered as stretched will not be delivered rolled without your prior consent. Shipping to you remains free of charge.

Collection from the studio

By arrangement, the work may be collected from the studio atHelenenstraße 16, 22765 Hamburg, Germany. Please arrange an appointment in advance at xenia@beliayeva.com. Where the contract of sale was already concluded online, consumers retain the statutory right of withdrawal even when collecting in person.

Withdrawal

Consumers have a statutory right of withdrawal. The details are set out in the Right of Withdrawal; the model withdrawal form is available there as well. You can also declare your withdrawal directly using the Cancel contract function.

You bear the direct cost of returning the goods. For works that can be returned by ordinary post — works on paper and canvases up to and including 50 × 70 cm — you return the goods yourself and bear the postage incurred.

For works on canvas from 60 × 80 cm upwards, which cannot be returned by ordinary post, we arrange collection in consultation with you. For this we charge you at most €59 per return within Germany and at most €79 per return from abroad. Where the actual direct cost of return is lower, we charge only that lower amount. We bear any transport costs beyond this. By exercising your right of withdrawal you agree that we may set this amount off against your refund; alternatively you may settle it separately.

Rights in respect of defects

The statutory rights in respect of defects apply. In the event of a damaged delivery or any other defect, please contact xenia@beliayeva.com. Who bears the costs of a justified claim in respect of defects is determined by statute; the provision above on return costs on withdrawal does not apply to such claims.

Copyright

With your purchase you acquire the physical original work. Rights of use under copyright, in particular for commercial reproduction or exploitation, are not granted without a separate agreement. Uses permitted by law are unaffected.

Contract language

These terms exist in a German and an English version. Both versions are of equal standing. The version that applies to your contract is the one in whose language you completed the purchase; the contract language of this version is English. If you purchased in English, we will conduct further correspondence in English as well.

Dispute resolution

I am neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
